Arbitrating construction disputes is not a new concept. Typically, the negotiating points for contractors are the type of arbitration, the number of arbitrators, and the location. However, now contractors must consider and negotiate whether the arbitrator will be a person or Artificial Intelligence.
In this presentation, we will outline what AI arbitration is, the existing and developing technology and discuss the efficiency, cost controls, consistency of applying standardized logic across similar cases to arrive at data-driven arbitration trends that can be beneficial for all parties involved. We will also discuss the role of AI arbitrations in construction disputes from a variety of perspectives including the construction lawyer, the general counsel for the contractor, a traditional arbitrator, and the surety. We will also discuss the pros, the cons, the risks, and the benefits of AI arbitration in the construction industry, which will include examples. Lastly, we will discuss a case study comparing the results of a traditional arbitration against the results generated by two different AI platforms.
The presentation aims to inform and educate the audience on the accelerated developments of AI in construction disputes and to generate a dialogue about the implications of AI’s adoption in the industry – both good and bad.
