The “standard of care” is no longer reserved for traditional professionals, such as architects and engineers. In today’s environment, Construction Managers (CMs) and General Contractors (GCs) are increasingly held to professional “standard of care” type obligations. The growing prevalence of these contractual provisions presents new questions and risks for contracting, project performance and evaluation, and claims and dispute resolution.
