The design standard of care is a foundational principle in construction but in practice, it can become a contentious issue during the bid development, design and construction phases of a project. Whether it is an EPC or Design Build project delivery method, the contractors and designers are managing how risk is allocated, managed, and at times deferred. Issues such as design quantities, design approaches and means and methods often become points of contention as design intent meets field conditions. As such, how designs are developed, coordinated, and communicated to support project execution becomes a challenge for the project team sometimes creating disputes between the stakeholders.
